Tratado de Paz com o Japão Assinado em São Francisco, 8 de setembro de 1951 Entrada em vigor inicial. 28 de abril de 1952 Nota: Nem a República da China nem a República Popular da China foram convidadas para a Conferência de Paz de São Francisco e tampouco participaram do Tratado de São Francisco. A República da China concluiu um Tratado de Paz separado com o Japão em 1952. O Primeiro-Ministro Yoshida Shigeru do Japão, cercado por altos membros da delegação japonesa, assina o tratado de paz em 8 de setembro de 1951. TRATADO DE PAZ COM JAPÃO CONSIDERANDO que as Potências Aliadas E o Japão resolvem que, doravante, suas relações serão as de nações que, como soberanas iguais, cooperam na associação amistosa para promover seu bem comum e para manter a paz e a segurança internacionais e desejam, portanto, concluir um Tratado de Paz que resolverá questões CONSIDERANDO que o Japão, por sua vez, declara sua intenção de solicitar a adesão à Organização das Nações Unidas e em todas as circunstâncias para se conformar com os princípios da Carta das Nações Unidas para lutar Alcançar os objetivos da Declaração Universal dos Direitos Humanos de procurar criar no Japão condições de estabilidade e bem-estar Na acepção dos artigos 55.º e 56.º da Carta das Nações Unidas e já iniciada pela legislação japonesa posterior à entrega e no comércio público e privado para se conformarem com práticas equitativas internacionalmente aceites. CONSIDERANDO que as Potências Aliadas acolhem com satisfação as intenções do Japão Por conseguinte, decidiram concluir o presente Tratado de Paz e, em conformidade, nomearam os Plenipotenciários abaixo assinados que, após apresentação dos seus plenos poderes reconhecidos em boa e devida forma, Acordou sobre as seguintes disposições: a) O estado de guerra entre o Japão e cada uma das Potências Aliadas é rescindido a partir da data em que o presente Tratado entrar em vigor entre o Japão ea Força Aliada interessada, conforme previsto no Artigo 23 B) As Potências Aliadas reconhecem a total soberania do povo japonês sobre o Japão e suas águas territoriais. A) O Japão, reconhecendo a independência da Coreia, renuncia a todo o direito, título e direito à Coreia, incluindo as ilhas de Quelpart, Port Hamilton e Dagelet. C) O Japão renuncia a todo o direito, título e direito às Ilhas Kuriles e à parte de Sakhalin e das ilhas adjacentes, sobre as quais o Japão adquiriu soberania em consequência do Tratado de Portsmouth de 5 de Setembro de 1905. d) Renuncia a todos os direitos, títulos e reivindicações em conexão com o Sistema de Mandato da Liga das Nações e aceita a ação do Conselho de Segurança das Nações Unidas de 2 de abril de 1947, estendendo o sistema de tutela às Ilhas do Pacífico anteriormente sob mandato ao Japão. E) O Japão renuncia a qualquer direito, título ou interesse relativo a qualquer parte da zona da Antártida, quer provenha de actividades de nacionais japoneses quer de outra forma. F) O Japão renuncia a todo o direito, título e direito às Ilhas Spratly e às Ilhas Paracel. O Japão concordará com qualquer proposta dos Estados Unidos às Nações Unidas para colocar sob seu sistema de tutela, com os Estados Unidos como a única autoridade administradora, Nansei Shoto ao sul de 29deg. Norte (incluindo as Ilhas Ryukyu e as Ilhas Daito), Nanpo Shoto ao sul de Sofu Gan (incluindo as Ilhas Bonin, Ilha de Rosario e as Ilhas Vulcão) e Parece Vela e a Ilha Marcus. Os Estados Unidos terão o direito de exercer todos e quaisquer poderes de administração, legislação e jurisdição sobre o território e os habitantes dessas ilhas, inclusive suas águas territoriais, até que sejam feitas essas propostas e medidas afirmativas. A) Sem prejuízo do disposto na alínea b) do presente artigo, a disposição dos bens do Japão e dos seus nacionais nas zonas referidas no artigo 2º e as suas reivindicações, incluindo dívidas, contra as autoridades que actualmente administram essas zonas e Os residentes (incluindo pessoas jurídicas) e a disposição no Japão de bens de tais autoridades e residentes, bem como de créditos, incluindo dívidas, de tais autoridades e residentes contra o Japão e seus nacionais, serão objeto de acordos especiais entre o Japão e Essas autoridades. Os bens de qualquer das Potências Aliadas ou dos seus nacionais nos domínios referidos no artigo 2.º, na medida em que tal não tenha sido feito, serão devolvidos pela autoridade administradora na condição em que ela existe. B) O Japão reconhece a validade das disposições de propriedade do Japão e dos nacionais japoneses, feitas por ou em conformidade com as directivas do Governo Militar dos Estados Unidos em qualquer das áreas referidas no presente Tratado. Nos artigos 2.oe 3.o c) Os cabos submarinos japoneses ligados ao Japão com território retirado do controlo japonês nos termos do presente Tratado devem ser igualmente divididos, o Japão a reter o terminal japonês ea metade adjacente do cabo e o território destacado o restante do O cabo e terminais de conexão. (A) O Japão aceita as obrigações estabelecidas no Artigo 2 da Carta das Nações Unidas. E em particular as obrigações de: (i) resolver os seus litígios internacionais por meios pacíficos de tal forma que a paz ea segurança internacionais ea justiça não sejam postas em perigo; (ii) abster-se nas suas relações internacionais da ameaça ou do uso da força contra a Integridade territorial ou independência política de qualquer Estado ou de qualquer outra forma incompatível com os propósitos das Nações Unidas; (iii) dar toda assistência às Nações Unidas em qualquer ação tomada de acordo com a Carta e se abster de prestar assistência a qualquer Estado Contra a qual as Nações Unidas podem tomar medidas preventivas ou de execução. (B) As Potências Aliadas confirmam que serão guiadas pelos princípios do Artigo 2 da Carta das Nações Unidas nas suas relações com o Japão. C) Por sua vez, as Potências Aliadas reconhecem que o Japão, enquanto nação soberana, possui o direito inerente à autodefesa individual ou colectiva a que se refere o Artigo 51 da Carta das Nações Unidas e que o Japão pode voluntariamente celebrar acordos de segurança colectiva. A) Todas as forças de ocupação das Potências Aliadas serão retiradas do Japão logo que possível após a entrada em vigor do presente Tratado e, em qualquer caso, o mais tardar 90 dias depois. Nenhuma disposição desta disposição impedirá, no entanto, o destacamento ou a retenção de forças armadas estrangeiras em território japonês, em virtude ou em consequência de acordos bilaterais ou multilaterais que tenham sido ou possam ser celebrados entre uma ou mais das Potências Aliadas, por um lado , E Japão, por outro. B) As disposições do artigo 9º da Proclamação de Potsdam, de 26 de Julho de 1945, relativas ao regresso das forças militares japonesas aos seus lares, na medida em que ainda não estiverem concluídas, serão efectuadas. C) Todos os bens japoneses para os quais não tenha sido já paga uma indemnização, que foi fornecida para o uso das forças de ocupação e que permanece na posse dessas forças aquando da entrada em vigor do presente Tratado, serão devolvidos Ao Governo japonês dentro dos mesmos 90 dias, a menos que outros acordos sejam feitos por mútuo acordo. CLÁUSULAS POLÍTICAS E ECONÓMICAS b) Qualquer notificação feita nos termos da alínea a) do presente artigo pode, excepto da operação ou revitalização de um tratado ou convenção, de um território para as relações internacionais de que a potência notificadora seja responsável, até três meses após a data Em que é notificada ao Japão que tal excepção deixa de ser aplicável. A) O Japão reconhecerá o pleno vigor de todos os tratados que as Potências Aliadas concluam ou concluam a seguir para pôr termo ao estado de guerra iniciado em 1 de Setembro de 1939, bem como quaisquer outros acordos das Potências Aliadas relativos ao restabelecimento do Estado Paz. O Japão também aceita as medidas tomadas para pôr termo à antiga Liga das Nações e à Corte Permanente de Justiça Internacional. B) O Japão renuncia a todos os direitos e interesses que possa derivar de um poder signatário das Convenções de St. Germain-en-Laye de 10 de setembro de 1919 e do Acordo de Estreito de Montreux de 20 de julho de 1936 e do Artigo 16 Do Tratado de Paz com a Turquia, assinado em Lausanne em 24 de Julho de 1923. c) O Japão renuncia a todos os direitos, títulos e interesses adquiridos ao abrigo do Acordo entre a Alemanha e os Credores de 20 de Janeiro de 1930 E seus Anexos, incluindo o Contrato de Fideicomisso, datado de 17 de maio de 1930, a Convenção de 20 de janeiro de 1930, respeitante ao Banco de Pagamentos Internacionais e aos Estatutos do Banco de Pagamentos Internacionais. O Japão notificará ao Ministério dos Negócios Estrangeiros de Paris, no prazo de seis meses a contar da primeira entrada em vigor do presente Tratado, a sua renúncia aos direitos, títulos e interesses referidos no presente número. O Japão entrará prontamente em negociações com as Potências Aliadas que desejem a conclusão de acordos bilaterais e multilaterais que prevejam a regulamentação ou limitação da pesca e a conservação e desenvolvimento da pesca no alto mar. O Japão renuncia a todos os direitos e interesses especiais na China, incluindo todos os benefícios e privilégios resultantes das disposições do protocolo final assinado em Pequim, em 7 de setembro de 1901, e de todos os anexos, notas e documentos complementares, e concorda com a revogação do Japão Do referido protocolo, anexos, notas e documentos. O Japão aceita os acórdãos do Tribunal Militar Internacional para o Extremo Oriente e de outros Tribunais Aliados de Crimes de Guerra dentro e fora do Japão e executará as sentenças impostas sobre os japoneses presos no Japão. O poder de conceder clemência, reduzir sentenças e liberdade condicional em relação a tais prisioneiros não pode ser exercido exceto por decisão do Governo ou dos Governos que impuseram a sentença em cada caso e por recomendação do Japão. No caso de pessoas sentenciadas pelo Tribunal Militar Internacional para o Extremo Oriente, esse poder não pode ser exercido senão por decisão da maioria dos Governos representados no Tribunal e por recomendação do Japão. A) O Japão declare pronta para entrar em negociações com vista a concluir com cada uma das Potências Aliadas tratados ou acordos que estabeleçam relações comerciais, marítimas e outras relações comerciais de forma estável e amigável. B) Na pendência da celebração do tratado ou acordo pertinente, o Japão concederá, durante um período de quatro anos a partir da primeira entrada em vigor do presente Tratado (1), a cada uma das Potências Aliadas, seus nacionais, produtos e navios ( I) tratamento da nação mais favorecida em relação aos direitos aduaneiros, encargos, restrições e outros regulamentos relativos à importação e exportação de mercadorias; ii) tratamento nacional no que diz respeito ao transporte marítimo, à navegação e às mercadorias importadas; Pessoas singulares e colectivas e seus interesses - tratamento que inclua todas as questões relativas à cobrança e cobrança de impostos, acesso a tribunais, celebração e execução de contratos, direitos de propriedade (tangíveis e intangíveis), participação em entidades jurídicas constituídas Direito japonês e, em geral, a conduta de todos os tipos de negócios e atividades profissionais (2) garantir que as compras externas e as vendas de empresas de comércio do Estado japonês shal I ser baseada unicamente em considerações comerciais. C) Contudo, no que diz respeito a qualquer assunto, o Japão será obrigado a conceder a um tratamento nacional da Aliada, ou tratamento da nação mais favorecida, apenas na medida em que a Potência Aliada interessada conceda ao Japão o tratamento nacional ou o tratamento mais favorecido, Se for caso disso, em relação à mesma matéria. A reciprocidade prevista na frase anterior será determinada, no caso de produtos, embarcações e entidades jurídicas e pessoas domiciliadas em qualquer território não metropolitano de uma Potência Aliada, e no caso de entidades jurídicas e pessoas domiciliadas Em qualquer estado ou província de uma potência aliada que tenha um governo federal, por referência ao tratamento concedido ao Japão em tal território, estado ou província. D) Na aplicação do presente artigo, não se considerará que uma medida discriminatória constitui uma derrogação à concessão do tratamento nacional ou da nação mais favorecida, consoante o caso, se essa medida se basear numa excepção habitualmente prevista no n. Os tratados comerciais da parte que a aplica ou a necessidade de salvaguardar a posição financeira externa ou a balança de pagamentos (excepto no que diz respeito à navegação e à navegação), ou sobre a necessidade de manter os seus interesses essenciais de segurança, Proporcionais às circunstâncias e não aplicadas de forma arbitrária ou não razoável. E) As obrigações assumidas pelo Japão ao abrigo do presente artigo não serão afectadas pelo exercício de quaisquer direitos conexos nos termos do artigo 14.º do presente Tratado, nem as disposições do presente artigo devem ser entendidas como limitativas dos compromissos assumidos pelo Japão por força do artigo 15.º do Tratado . (A) O Japão entrará em negociações com qualquer das Potências Aliadas, prontamente a pedido de tais Poderes ou Poderes, para a conclusão de acordos bilaterais ou multilaterais relativos ao transporte aéreo civil internacional. B) Na pendência da celebração de tal acordo ou acordos, o Japão, durante um período de quatro anos a partir da primeira entrada em vigor do presente Tratado, estenderá a esse Tratamento não menos favorável em relação aos direitos e privilégios de tráfego aéreo do que Os exercidos por qualquer dessas Potências na data da sua entrada em vigor, e concederá total igualdade de oportunidades no que diz respeito ao funcionamento e ao desenvolvimento dos serviços aéreos. C) Na pendência da sua adesão à Convenção sobre a Aviação Civil Internacional, nos termos do seu artigo 93º, o Japão aplicará as disposições dessa Convenção aplicáveis à navegação internacional de aeronaves e aplicará as normas, práticas e Procedimentos adotados como anexos à Convenção, de acordo com os termos da Convenção. RECLAMAÇÕES E PROPRIEDADE a) Reconhece-se que o Japão deve pagar reparações às Potências Aliadas pelos danos e sofrimentos causados durante a guerra. No entanto, reconhece-se também que os recursos do Japão não são actualmente suficientes para manter uma economia viável, reparar integralmente todos os danos e sofrimentos e, ao mesmo tempo, cumprir as suas outras obrigações. 1. O Japão entrará prontamente em negociações com as Potências Aliadas tão desejadas, cujos territórios atuais foram ocupados pelas forças japonesas e danificados pelo Japão, a fim de ajudar a compensar esses países pelo custo da reparação dos danos causados, disponibilizando os serviços Do povo japonês na produção, salvamento e outros trabalhos para as Potências Aliadas em questão. Tais acordos evitarão a imposição de responsabilidades adicionais a outras Potências Aliadas e, quando for exigido o fabrico de matérias-primas, serão fornecidos pelas Potências Aliadas em questão, de modo a não lançar sobre o Japão qualquer ónus cambial. 2. (I) Sob reserva do disposto na alínea (II) infra, cada uma das Potências Aliadas terá o direito de apreender, reter, liquidar ou dispor de qualquer forma de todos os bens, direitos e interesses de: a) Japoneses e japoneses, B) Pessoas que actuem em nome ou por conta do Japão ou de nacionais japoneses, e c) Entidades detidas ou controladas por nacionais japoneses ou japoneses que, na primeira entrada em vigor do presente Tratado, estão sujeitos à sua jurisdição. Os bens, direitos e interesses especificados nesta alínea incluirão aqueles que estão agora bloqueados, posse ou na posse ou sob o controlo de autoridades de propriedade inimiga de Potências Aliadas, que pertencem ou foram mantidos ou geridos em nome de qualquer das pessoas Ou entidades mencionadas nas alíneas (a), (b) ou (c) acima, no momento em que tais ativos ficaram sob o controle de tais autoridades. I) A propriedade de pessoas singulares japonesas que durante a guerra residiram com a autorização do Governo interessado no território de uma das Potências Aliadas, com excepção do território ocupado pelo Japão, com excepção das propriedades sujeitas a restrições durante a guerra e não libertadas (Ii) todos os bens imóveis, mobiliário e utensílios de propriedade do Governo do Japão e utilizados para fins diplomáticos ou consulares, e todos os móveis e mobiliário pessoal e outras propriedades privadas não abrangidos pelo presente Acordo (Iii) bens pertencentes a organismos religiosos ou instituições caritativas privadas e utilizados exclusivamente para fins religiosos ou de caridade; (iv) propriedade, Direitos e interesses que se encontrem sob a sua jurisdição em consequência da retomada das negociações comerciais e (V) obrigações do Japão ou dos nacionais japoneses, qualquer direito, título ou interesse sobre bens corpóreos localizados no país em causa, No Japão, interesses em empresas organizadas de acordo com as leis do Japão ou quaisquer provas em papel, desde que essa exceção se aplique apenas às obrigações do Japão e de seus nacionais expressas em moeda japonesa. (III) Os bens referidos nas exceções (i) a (v) acima serão devolvidos sujeitos a despesas razoáveis para sua preservação e administração. Se algum desses bens tiver sido liquidado, o produto será devolvido. (IV) O direito de apreender, reter, liquidar ou de outra forma dispor de bens, conforme previsto no parágrafo (I) acima, será exercido de acordo com as leis do Poder Aliado interessado e o proprietário terá apenas os direitos que possam ser dados Por essas leis. (V) As Forças Aliadas concordam em negociar com as marcas japonesas e os direitos de propriedade literária e artística numa base tão favorável ao Japão como as circunstâncias em cada país permitirão. B) Salvo disposição em contrário do presente Tratado, as Potências Aliadas renunciam a todas as reclamações de reparação das Potências Aliadas, a outras reivindicações das Potências Aliadas e dos seus nacionais decorrentes de quaisquer medidas tomadas pelo Japão e seus nacionais durante o processo Da guerra e reivindicações das Potências Aliadas para os custos militares diretos de ocupação. A) Mediante requerimento apresentado no prazo de nove meses a contar da data de entrada em vigor do presente Tratado entre o Japão ea Potência Aliada interessada, o Japão devolverá os bens tangíveis e intangíveis e todos os direitos Ou interesses de qualquer espécie no Japão de cada Poder Aliado e seus nacionais que estavam dentro do Japão em qualquer momento entre 7 de dezembro de 1941 e 2 de setembro de 1945, a menos que o proprietário tenha livremente disposto sem coacção ou fraude. Tais bens serão devolvidos livres de todos os ônus e encargos a que pode ter ficado sujeito por causa da guerra, e sem quaisquer encargos para sua devolução. Os bens cujo retorno não for solicitado pelo proprietário ou pelo seu Governo no prazo prescrito poderão ser cedidos pelo Governo japonês, conforme determinar. Nos casos em que esses bens estivessem dentro do Japão em 7 de Dezembro de 1941 e não pudessem ser devolvidos ou sofreram danos ou prejuízos como resultado da guerra, a compensação será feita em condições não menos favoráveis do que as previstas no projecto de Allied Powers Property Compensation Lei aprovada pelo Gabinete do Japão em 13 de Julho de 1951. b) No que diz respeito aos direitos de propriedade industrial prejudicados durante a guerra, o Japão continuará a conceder às Potências Aliadas e aos seus nacionais benefícios não inferiores aos até agora concedidos pelas Portarias n. º 309 Com vigência a partir de 1 de Setembro de 1949, n. ° 12 a partir de 28 de Janeiro de 1950, e n. ° 9 a partir de 1 de Fevereiro de 1950, tudo tal como agora alterado, desde que esses nacionais tenham solicitado essas prestações dentro dos prazos nele previstos. C) i) O Japão reconhece que os direitos de propriedade literária e artística existentes no Japão em 6 de Dezembro de 1941 relativamente às obras publicadas e não publicadas das Potências Aliadas e dos seus nacionais continuaram em vigor desde essa data e reconhece as Direitos que tenham surgido, ou que, para a guerra, surgiram no Japão desde essa data, através da aplicação de quaisquer convenções e acordos em que o Japão fosse parte nessa data, independentemente de essas convenções ou acordos terem sido revogados ou Suspenso após o início da guerra pelo direito interno do Japão ou do Poder Aliado interessado. (Ii) Sem a necessidade de aplicação pelo titular do direito e sem pagamento de qualquer taxa ou cumprimento de qualquer outra formalidade, o período compreendido entre 7 de dezembro de 1941 e a entrada em vigor do presente Tratado entre o Japão e a Aliada Ficam excluídos do período normal de vigência desses direitos e esse prazo, com um período adicional de seis meses, será excluído do prazo em que uma obra literária deve ser traduzida para o japonês a fim de obter direitos de tradução no Japão. Como expressão de seu desejo de indenizar os membros das forças armadas das Potências Aliadas que sofreram dificuldades indevidas enquanto prisioneiros de guerra do Japão, o Japão transferirá seus bens e os de seus nacionais em países neutros durante a guerra ou que Estavam em guerra com qualquer uma das Potências Aliadas ou, a seu critério, com o equivalente a esses bens, ao Comitê Internacional da Cruz Vermelha, que liquidará esses bens e distribuirá o fundo resultante às agências nacionais apropriadas, em benefício dos antigos Prisioneiros de guerra e suas famílias, nas bases que julgarem equitativas. Ficam excluídas da transferência as categorias de bens descritas no Artigo 14 (a) 2 (II) (ii) a (v) do presente Tratado, bem como os bens de pessoas singulares japonesas não residentes no Japão na primeira entrada em vigor Do Tratado. Entende-se igualmente que a disposição de transferência deste Artigo não tem aplicação às 19.770 ações do Banco de Pagamentos Internacionais atualmente detidas por instituições financeiras japonesas. (A) A pedido de qualquer das Potências Aliadas, o Governo japonês revisará e revisará, em conformidade com o Direito Internacional, qualquer decisão ou ordem dos Tribunais do Prêmio do Japão em casos envolvendo direitos de propriedade de nacionais daquela Potência Aliada e fornecerá cópias de Todos os documentos que compõem os registros desses casos, incluindo as decisões tomadas e as ordens emitidas. Em qualquer caso em que tal revisão ou revisão demonstre que o restabelecimento é devido, o disposto no artigo 15.º é aplicável ao imóvel em causa. B) O Governo japonês tomará as medidas necessárias para que os nacionais de qualquer das Potências Aliadas possam, a qualquer momento no prazo de um ano a contar da entrada em vigor do presente Tratado, entre o Japão e a Potência Aliada interessada apresentar às autoridades japonesas competentes Rever qualquer sentença proferida por um tribunal japonês entre 7 de Dezembro de 1941 e essa entrada em vigor, em qualquer processo em que qualquer nacional desse tipo não pudesse apresentar adequadamente o seu caso como demandante ou réu. O Governo japonês estabelecerá que, se o nacional tiver sofrido um dano em virtude de tal decisão, será restabelecido na posição em que se encontrava antes da sentença ter sido proferida ou será concedido o alívio que possa ser justo e equitativo circunstâncias. A) Reconhece-se que a intervenção do estado de guerra não afectou a obrigação de pagamento de dívidas pecuniárias decorrentes de obrigações e contratos (incluindo os relativos a obrigações) que existiam e direitos adquiridos antes da existência de um Estado De guerra e que sejam devidos pelo Governo ou por nacionais do Japão ao Governo ou a nacionais de uma das Potências Aliadas, ou sejam devidos pelo Governo ou por nacionais de uma das Potências Aliadas ao Governo ou nacionais do Japão. A intervenção de um estado de guerra também não será considerada como afetando a obrigação de considerar em seu mérito reclamações por perda ou dano à propriedade ou por danos pessoais ou morte que surgiram antes da existência de um estado de guerra e que podem ser apresentadas Ou reapresentado pelo Governo de uma das Potências Aliadas ao Governo do Japão ou pelo Governo do Japão a qualquer dos Governos das Potências Aliadas. As disposições do presente parágrafo não prejudicam os direitos conferidos pelo artigo 14.º. b) O Japão afirma a sua responsabilidade pela dívida externa anterior ao Estado japonês e pelas dívidas de pessoas colectivas posteriormente declaradas como passivos do Estado japonês e expressa A sua intenção de iniciar negociações com os seus credores com uma data aproximada com respeito à retomada dos pagamentos dessas dívidas para encorajar negociações em relação a outros créditos e obrigações anteriores à guerra e facilitar a transferência de somas em conformidade. A) O Japão renuncia a todas as reivindicações do Japão e dos seus nacionais contra as Potências Aliadas e os seus nacionais decorrentes da guerra ou das acções tomadas devido à existência de um estado de guerra e renuncia a todas as reclamações decorrentes da presença, Ações de forças ou autoridades de qualquer das Potências Aliadas em território japonês antes da entrada em vigor do presente Tratado. Once a highly regarded prospect with the Nationals, Marrero has scant MLB time, but did slash a productive .284.344.494 and hit a career-best 23 home runs in 544 Triple-A plate appearances last year with the Red Sox organization. By Jeff Todd February 24, 2017 at 9:45pm CDT While the Giants already had a host of internal options for their few MLB openings, the club brought in a wide range of alternatives to compete for jobs in camp. It8217s possible to imagine the team sticking with some old favorites, but the added contenders create some intrigue as the club looks to overtake a powerful Dodgers team in the NL West. Here are San Francisco8217s ongoing camp battles click here for previous entries in MLBTRs Camp Battles series. A pair of deadline swaps drastically altered the outlook for the Giants at the hot corner 8212 out went Matt Duffy . in came Nunez 8212 and the team has gone on to add a whole host of competitors for time there. Given the commitment to Nunez, and his lack of an obvious alternative position, it seems likely that he8217ll earn the lion8217s share of the time, but perhaps it8217s not etched in stone. Also at stake in this battle is a job as a utility infielder. Hwang represents the most intriguing alternative. He showed a fantastic blend of power and plate discipline last year, though it came in the hitter-friendly KBO and he had to settle for a minor league deal in his bid to make it in the majors. But if any of these players is a threat to Nunez as a semi-regular at third, it may be the unknown Hwang. Of course, Hill has shown life in the not-so-distant past, and could also be a real contender with a big spring. Beckham would have quite an uphill climb to lay such a claim himself, though the team thought enough of him in a brief cameo late last year to bring him back on a minors deal. Gillaspie was a surprising postseason hero, and may be a favorite for an Opening Day nod, though he8217d likely factor as a platoon candidate at the hot corner. Rollins may fight with Tomlinson and Calixte for a true utility spot. All are capable of playing shortstop, which doesn8217t hold for any of the other players 8212 excepting Nunez, who could conceivably add value as a heavily used multi-position player rather than parking on third base. Prediction: Nunez holds serve, with Gillaspie seeing time against righties. But I8217ll guess Hwang stakes out a roster spot, too, and plays third on occasions when Nunez spells left-handed-hitting middle infielders Brandon Crawford and Joe Panik . The Giants have made clear they8217d like someone to take the job as a semi-regular in left, which makes this a true battle for an important role 8212 albeit one that could change as the season goes on. Indications are that the out-of-options Parker will battle with Williamson for the job. Both have shown signs of promise in the upper minors and in their brief time in the bigs, though neither has yet been given a full opportunity to sink or swim at the game8217s highest level. While a platoon makes sense at first glance, it8217s trickier in practice. Indeed, GM Bobby Evans has strongly suggested that he doesn8217t really love the idea of both Parker and Williamson being on the same roster. The former hasn8217t shown evidence that he can succeed against lefties, making him a prime candidate to be spelled by a lefty bench bat. But the latter is also better historically against right-handed pitching, meaning he8217s not an optimal candidate to do so. Given the array of veterans assembled here, it seems that San Francisco is giving thought to a few scenarios. If Parker can win the job, as Evans says is his hope, then the club could option Williamson and keep a lefty masher on hand to share time in left and perhaps also spell Brandon Belt at first. Morse and Ruggiano will try to show what they have left this spring, while Blanks will look to get his career on track after a series of injuries, but Marrero could also be a real consideration given that the team targeted him early in the offseason. Any of those players could also conceivably coexist with Williamson, though that would leave just one left-handed-hitting outfielder in Denard Span . Hernandez, meanwhile, occupies a somewhat different place in the picture. Despite a lack of significant MLB time, he has shown a high-OBP approach in the upper minors. Hernandez could ease the burden on Span in center he8217s also out of options. Prediction: This is an exceedingly difficult situation to prognosticate, but sometimes you have to go with your gut. I8217ll guess that the Giants preserve their control rights and flexibility by handing near-regular duties to Parker, with Williamson optioned back to Triple-A to open the year. Hernandez will be the fourth outfielder, seeing most of his time in center, while one of the four righty bench bat candidates will take a job as well. My guess is Ruggiano, who has actually been rather productive in recent years when healthy and given a MLB opportunity. ROTATION (ONE SPOT) Matt Cain Age: 32 Throws: R Contract Status: 1 year, 20MM (club option for 2018 at 21MM, with 7.5MM buyout vests with 200 IP if Cain doesn8217t end year on DL for elbowshoulder injury) Options remaining: Can8217t be optioned without consent This certainly appears to be Cain8217s job to lose barring injury, it8217s difficult to imagine he won8217t get another shot at rediscovering his form. Given his salary and history with the organization, he8217ll have every chance of proving that he8217s back to health 8212 and that his last two seasons (combined 5.70 ERA over 150 frames) aren8217t a reflection of his true talent going forward. While there8217s limited opportunity for other hurlers to snatch the job based solely on their performances in camp, there are contenders. Suarez is perhaps a swingman option after giving the Giants 84 serviceable frames in 2016. Blach had a nice debut last year, though it was brief and he doesn8217t carry overwhelming minor-league numbers. Much the same holds true of Stratton. Meanwhile, Blackburn has shown signs of greater upside, though he managed only a 4.36 ERA with 6.7 K9 and 2.3 BB9 in his repeat of Triple-A last year. Looking somewhat further down the line, Tyler Beede headlines the team8217s prospect pool in the rotation department, and he could soon be ready after strong year at Double-A in 2016. Prediction: Cain gets the job out of camp, but could be pressured relatively early in the season. The wild card here is the health of lefty Will Smith . who has been slowed early. Any setback could not only open up another job (at least temporarily), but lock up Okert8217s already strong hold on an Opening Day roster spot. While he only threw 14 MLB frames in his debut last year, Okert recorded a strikeout per inning and also racked up sixty punchouts to go with just 11 walks in his 47 13 Triple-A frames. Osich was a similar story entering camp last year, but struggled badly in his sophomore campaign (4.71 ERA, 6.2 K9, 4.7 BB9 in 36 13 innings) and seems destined for a reboot. The other lefty, Reynolds, has an outside shot at factoring in despite his lack of recent contributions in the majors, though perhaps that8217s mostly plausible in the event that Smith is shelved. On the righty side of the equation, Gearrin and Kontos seem to have the inside track. Gearrin bounced back from two injury-limited seasons to post a 4.28 ERA, though it came along with a solid 8.4 K9 and 2.6 BB9. Kontos, meanwhile, has produced outstanding results in recent years (2.49 ERA in 159 innings) while he has averaged only 6.0 K9 against 2.4 BB9, he has managed to suppress the runs by generating lots of weak contact (.260 lifetime BABIP). Those pitchers could be challenged, though, and it8217s worth bearing in mind their arb deals aren8217t guaranteed (so far as has been reported, at least). Hernandez is fresh off of an uneven year in which he landed with a 3.84 ERA over 72 23 innings while he coughed up four free passes per nine, he also racked up 9.9 K9 and showed he was healthy. Morris and Ramirez have more to prove, given their health situations, but have big arms and have had success in the majors in the past. The above-noted Suarez (if not one of the optionable rotation candidates) could also factor here if the Giants elect to keep a long man 8212 and especially if they choose to forego an extra position player on the bench. Dan Slania is another name to consider, perhaps he showed well in the upper minors last year and could surprise in camp. Prediction: I8217ll go with a somewhat conventional outlook here, predicting that Gearrin and Kontos keep their jobs and are joined by Okert. Just to mix things up, though, I8217ll also guess that Smith is unable to start the year in the majors, opening the door to the team preventing Hernandez from opting out by placing him on the active roster.
